1. SCOPE
The privacy policy applies to the website www.fenion.com and the products ARC, INSTAX, SMINT, PKG and to all Fenion data feeds, in particular regulatory or individual reporting data (amongst others BMSVG, PKG, Solvency II, Solva, CRR, AIFMD,VAG, FundsXML) as well as our sustainability services.
By using Fenion services, products and the Fenion website, you consent to the collection and processing of personal data described within this privacy policy as well as to analysis of the use of the services and the use of cookies, Google Analytics.
2. WHAT PERSONAL DATA IS PROCESSED?
Depending on the use of our products and services, different personal data will be processed.
In the context of the business relationship and/or initiation, Fenion processes the following personal data:
- Contact details (name, address, e-mail, telephone number)
- Identification data (when logging in to ARC)
- Bank account
- Invoicing data
- Contract data
- History of the business relationship (e-mail communication)
Additionally, by using our services, products and web services, data is generated, which is automatically transmitted from your browser to Fenion:
- Date and time of login
- IP-Address
- Browser
The data is treated strictly confidential by Fenion.
3. PURPOSE OF DATA PROCESSING
The data is processed on the basis of your consent (Art. 6 para. 1a GDPR) as well as on the basis of Fenion's legitimate interest (Art. 6 para. 1a EU GDPR).
Furthermore, your personal data will be processed for the performance of a contract and for the execution of pre-contractual measures (Art. 6 para. 1b GDPR) as well as for compliance with legal obligations (Art. 6 para. 1c GDPR).
The data is required for the following purposes:
- Processing your requests
- Sending our newsletter
- Ongoing operation
- User identification for our web services
- Compliance with regulatory requirements
- Further development of products and services
- To prevent abuse
4. DISCLOSURE OF DATA / DELETION OF DATA
Your data will only be processed by those employees who need it to fulfil the contractual, pre-contractual and legal obligations.
Your data will be passed on to the third-party provider Zoho Campaigns (newsletter), provided that we have explicit consent to send newsletters.
The data will not be passed on to other third parties, subject to legal obligations to disclose data.
The deletion of personal data takes place at your explicit request and upon revocation of consent to the processing of such data. In addition, it will be deleted if the data is no longer needed for the actual purpose.
Data from existing business relationships will be processed for the duration of the business relationship and beyond, depending on legal requirements.
5. DATA PROTECTION RIGHTS
You have the right to obtain information about your personal data stored by us at any time. You also have the right to correction, deletion, restriction, revocation and objection. Your rights exist insofar as the exercise of the right does not conflict with the fulfilment of Fenion's legal obligations or the processing is necessary for the enforcement or defence of Fenion's legal claims.
If you believe that the processing of your data violates the Data Protection Law, you can lodge a complaint with our Data Protection Officer (see below) or with the Data Protection Authority.
6. IS THERE AN OBLIGATION TO PROVIDE DATA
An obligation to transmit data exists if Fenion is legally obliged to collect the data, or if this is necessary for the initiation and/or execution of the business relationship.
7. DATA PROCESSING IN THE CONTEXT OF THE APPLICATION PROCESS / STORAGE PERIOD / RIGHTS
By submitting application documents, you agree to the processing of your personal data. The data is processed and stored on the basis of our legitimate interest in filling a position (in accordance with Article 6 para 1 lit f GDPR) and on the basis of pre-contractual measures (Article 6 para 1 lit b GDPR). The data is collected by providing it by you, or as part of our own records. The data will only be used for the stated purpose and not shared with third parties without your consent.
Storage period
In the event of a rejection, we will keep your data for six months from the date of application. In the event of a successful application, the data will be stored for as long as required by statutory retention periods or until legal claims are time-barred.
Your rights
You have the right to obtain information about your personal data stored by us at any time. You also have the right to correction, deletion, restriction, revocation and objection. If you believe that the processing of your data violates the Data Protection Law, you can lodge a complaint with our Data Protection Officer (see below) or with the Data Protection Authority.
8. USE OF GOOGLE ANALYTICS
This website uses Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics uses so-called "cookies", which are text files that are stored on your computer and enable an analysis of your use of the website. The information generated by cookies about your use of this website is usually transmitted to a Google server in the USA and stored there. However, due to the activation of IP anonymization on these websites, your IP address will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide the website operator with other services related to website activity and internet usage. In doing so, an opt-out cookie will be installed on your device. 9. GOOGLE ADWORDS
Our website uses Google Conversion Tracking. If you have reached our website via an advertisement placed by Google, Google Adwords will place a cookie on your computer. The conversion tracking cookie is set when a user clicks on an ad served by Google. These cookies expire after 30 days and are not used for personal identification.
If the user visits certain pages of our website and the cookie has not yet expired, we and Google can recognize that the user clicked on the ad and was redirected to that page. Each Google AdWords customer receives a different cookie. This means that cookies cannot be tracked across the websites of AdWords customers. The information collected by the conversion cookie is used to compile conversion statistics for AdWords customers who have opted in to conversion tracking. Customers will see the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users.
